Employees may engage in outside business activities outside Laboratory hours and away from the Laboratory as long as such activities do not interfere with performance of their Laboratory duties, create a real or apparent conflict of interest or subject DOE or the Laboratory to public criticism or embarrassment. However, prior review and approval are required for outside professional activities, including but not limited to, outside employment, consulting, or service on a Science Advisory Board or Board of Directors, when such activities involve any scientific or technical organization, any organization with which the Laboratory does business, or work paid by federal or University of California funds. The Laboratory’s procedures for review and approval of such activities have expanded to include a number of institutional reviews, and, as circumstances warrant, review by a conflict of interest advisory committee. Accordingly, the form, “Request to Engage in Outside Employment” will be replaced by a new form, Request for Approval of Compensated Outside Professional Activity, which will be issued shortly. Berkeley Lab's conflict-of-interest policies apply to all employees, including faculty members, who perform work under the UC/DOE Contract, including work for others, regardless of the percent time employed. The conflict-of-interest policies stem from the Lab management contract between the University of California and DOE, University policy, and federal and state laws and regulations. Penalties for failure to comply with these policies may result in disciplinary action by the Laboratory and prosecution under state law.
